Thanks to Ruud van der Velden who sent this to us, origianlly from Launch.com: Lars Ulrich of Metallica revealed that he will testify before the Senate as a subcommittee examines the effect of music file-swapping software Napster on the music industry. Ulrich will visit Washington, D.C., within the next two weeks. He told LAUNCH about what he wants Senate members to know about Metallica's beef with Napster. "I think the key thing, really, here is information," Ulrich said. "I believe that the reason people are saying what they're saying is only out of sheer ignorance. Whenever I get 20 minutes with somebody, they -- even if they don't necessarily 100% agree -- they can see the positions and they understand the arguments. There is no argument here. All we want as an artist is a choice. There's nothing to argue about that. Nobody has the right to do with our music whatever they want. We do. The Boston Globe has an interview with Lars. Some quotes: "It was more about `We're going on the road, and let's see who wants to join us.' Then, all of a sudden, you get the two biggest other rock entities, Korn and Kid Rock, who want to come along for the fun, and all of a sudden it became a different thing. Which is cool because we haven't really done this thing for a while.'' After the tour ends, Ulrich says, the band members will chill - Hetfield may hunt in Argentina, Ulrich plans to take his son to the park in Santa Barbara a lot - and reconvene in January ''to get back to ultimately doing what this is really all about, which is creating and formulating new music and new ideas.'' Slip Knot Web reports the following quotes from the band’s drummer Joey Jordison (via NME): "Metallica are one of the biggest rock bands in the goddamn world, so what the hell would they need to sue Napster for? It is retarded." Continuing, Jordison stated... "What we are doing with our next album is we are giving one site the exclusive rights to release our album over the Internet so we have control and get paid for it." and "What bands need to realise is that it will always be more fun to go and buy a CD with the booklet and information take it home to listen to rather than download music onto some shitty arse disc. The cheapskate assholes who aren’t that much into music are going to do that, but I'll buy a CD every time." We're unclear if Mr. Jordison is aware of what the word hypocrite means, or what the word "retarded" means... we do know that he refers to his fans as "maggots," wears a mask on stage, and is know for doing interesting things with feces. James original white Gison Explorer appears to have popped up on eBay, the guitar, which by our estimates appears to legitmate, has a starting price of $25,000. UPDATE: The auction has been pulled from eBay, and although we still think the guitar looks quite authentic, Antonio tells us differently: "Don't be fooled. This guitar appears to be not authentic even by looking at the pictures. In addition, James never had a guitar that said "So what" like that and had that sticker. This appears to be a scam. There are a lot of people out there tryin to make a quick buck. In addition, the seller covers his tracks by never stating in the auction that the guitar ever belonged to James. Beware!!" ...adding the naysayers, Michael from Long Beach, CA Home of the Long Beach Arena Riot, Jusitice Tour '88 tells us: "The guitar at E-Bay is clearly a fake. Three reasons why. #1 J's guitar has EMG pick-ups on it. That was does not. #2 J's guitar has a hand-painted Zorlac "shinking head" painted above the SO WHAT, which incidently is carved into the body with a knife. That guitar has no shrinking head. #3 The demon head on J's guitar has a bubble coming off the mouth that contains a few words. The one at E-bay looks like a sticker and does not have the bubble off the mouth. Refer to Justice Tour Program for pics of the real one." (we would just like to state that James modifies guitars all the time, this could be the reason stickers/paintings disappear, for example the Zorlas sticker/painting looks like it was there at some point, although the lack of EMG's is a very compelling argument that this is a fake). Elektra's Metallica Site announced a release date for the S&M DVD of June 13th, Circuit City's Sunday circular also announced the DVD to be available that day. However, it did not appear.. Circuit City salesperson's stated it was delayed, possibly to next week. We do hear word that the DVD is already availble in Australia and the UK. The official Metallica website still has a release date of June 27th posted. NAPSTER UPDATE
The RIAA asked a preliminary injunction against Napster, ordering the popular MP3-download software company to cease making copyrighted material available. Somewhat incriminatingly, Napster CEO stated in a press release: "This case is about whether it is legal to share MP3 versions of sound recordings over the Internet. We say yes -- the major labels say no." MP3.com and the MPAA (Motion Picture Association of America) are the latest to throw their hats into the Napster fracas. MP3.com Chairman Michael Robertson states: "In my view, Napster is not designed to promote or share the music of unknown or lesser known artists. The only way to find a song on Napster is to enter the name of the song and/or artist that the user wants to find." "In the operation of our Website, we do not authorize unlawful or pirated MP3 files, We engage in an intensive screening effort to ensure this, which we believe is an appropriate cost of doing business." MPAA President Jack Valenti states: "If Napster can encourage and facilitate the distribution of pirated sound recordings, then what's to stop it from doing the same to movies, software, books, magazines, newspapers, television, photographs or video games?" MTV will be backstage and behind the scenes with all the goings on at the EMP grand opening celebration and June 23 Memorial Stadium concert. MTV News' Kurt Loder and Chris Connelly will check in from the event the week of June 26-30 with news pieces airing daily during "Total Request Live" at 3:30 PM (ET/PT) and updates airing throughout the day on MTV News. Metallica's music for I Disappear appears in the current issue of Guitar One. Although, we really think the song is D-tuned, not Eb as printed in the mag. Live Daily reports that TVT Records has filed a lawsuit against Napster, joining Metallica and Dr. Dre. Read it here. Metallica.com seems to have been temporarily replaced for some websurfers by the Indigo Girls. We are told this is a glitch that is already working it's way out of the system... so Metallica.com is already back up and running for some! Kid Rock's latest CD, History of Rock, which features Amercian Badass, his re-tooling of Metallica's Sad But True, features a picture of him and Lars on the ski slopes, and a live pic of Kid and James onstage. It also gives writing credit to the band and special thanks and a note to Lars. MTV posted some Real Video clips of Kirk from the M:I-2 Premeire about the then upcoming MTV Movie Awards. Here's what Kirk had to say: "It's gonna be interesting playing to a bunch of actors... rather than playing to a bunch of industry people and musicians. Rolling Stone reports that: "SLAYER and SEPULTURA have been added to the Tattoo the Earth Tour. The tour's organizers are also negotiating a deal to join forces with METALLICA's Summer Sanitarium Tour beginning in late July." This verifies what we have been reporting in our Rumor Mill... UPDATE: From MTV.com:"Heavy music power hitters Slayer and Sepultura are the latest acts to sign on for this summer's inaugural run of the Tattoo The Earth tour, and Metallica may join them, if only for one show. The upstart hard rock caravan already boasts a lineup that includes Slipknot, Sevendust, Coal Chamber, (hed) pe, Nashville Pussy, and Mudvayne and has now added Slayer, Sepultura, and Famous to the bill, according to press representatives for the tour. The addition of Sepultura (the band that guitarist/vocalist Max Cavalera fronted until an acrimonious split in 1997) is ironic, given that the band is replacing Cavalera's new band, Soulfly, on the bill. As we previously reported, Soulfly left the tour for a slot on this summer's Ozzfest outing. Sources close to Tattoo The Earth also tell MTV News that tour organizers are working with Metallica in an effort to get that band on the bill for one show at Giants Stadium in East Rutherford, New Jersey in late July. Yes, it has been a long time, but... Sonicnet reports that "More than 30,000 users of the controversial MP3 file-sharing program Napster have had their accounts reinstated after swearing — under penalty of perjury — that they were mistakenly accused of illegally trading in copyrighted Metallica song files." Metallica has decided to"not to take any action against these users" who were allegedly "copyright infringers." Click here for the whole article. Rolling Stone reports that "In order to keep fans up to date with the war against NAPSTER, METALLICA have launched an online forum on the subject at www.artistdirect.com. Beginning this week, the band will check in on a semi-regular basis to post progress reports on its legal battle with the music-trading software maker. " Metallica will be performing 'I Disappear' this Thurday for this year's MTV Movie Awards (June 8), hosted by Sarah Jessica Parker. The show airs at 9pm EST.
