Metallica.com has posted an exclusive 5 minute video in the Members Only section. The video is behind the scenes type of footage from the last show. In addition, they have reopened their Members Only Gallery featuring pictures from previous tours as well as Members Only pics from the Summer Sanitarium, not to mention full length music videos, available in Windows Media Player and Real Player formats in various speeds.

NAPSTER TRIAL DATE SET

Infobeat reports:

"A federal appeals court said Tuesday it would hear oral arguments in the Napster Inc. case the first week of October. The 9th U.S. Circuit Court of Appeals said a three-judge panel will hear the case sometime between Oct. 2-6 in San Francisco. The court, which in the past year has issued rulings in favor of technology despite concerns of copyright infringement, national security and Internet monopolies, is hearing the recording industry's case against the Internet site that acts as a gateway for millions of online surfers to exchange and record copyrighted music. The recording industry wants Napster shut down, alleging it is contributing to widespread copyright infringement. Napster maintains it is just providing a service for users to share music and not all of the music is copyright protected. The 9th Circuit temporarily halted a federal judge's July order shutting down Napster. The court's announcement Tuesday came as various groups filed so-called friend-of-the-court briefs urging the 26-judge court to allow Napster to continue its music-swapping service.

One of the largest trade groups to submit papers was the Consumer Electronics Association, which represents 600 members including America Online Inc., Apple Computer, Intel and Microsoft Corp. The group contends U.S. District Court Judge Marilyn Hall Patel misapplied copyright law that protects technologies with "substantial non-infringing uses." If her decision is used as precedent for other cases, it could threaten development across the consumer technology sector, they say.

The association and others are concerned about Patel's rejection of Napster's defense that compared its software to videocassette recorders. Like VCRs, which the U.S. Supreme Court has ruled are legal despite being able to copy protected movies, Napster also is capable of substantial non-infringing use, the groups said.

Patel dismissed that argument. Napster's internal documents show the company had created the software largely to facilitate piracy and that company executives knew the piracy was widespread.

The Association of American Phsycians & Surgeons also weighed in, saying Patel's decision could chill "the dissemination of important therapeutic medical information."

Allstar reports:

"Never let it be said that Tom Cruise doesn't get his money's worth. Paramount Home Video has announced that the upcoming DVD release of Cruise's Mission: Impossible 2 (out Nov. 7) will include Metallica's video for the song "I Disappear." The song was one of the big hits from the movie's soundtrack."

Seb send us this: "A limited edition of METALLICA's M:I-2 single, 'I Disappear' will be available featuring the album version and instrumental of the track plus a previously unreleased non-album track. The single will be limited to 20,000 copies." (we're not too sure about this, so be warned!)

A says: the August 31st Rolling Stone Random Notes has some photos of the guys with Kid Rock wake boarding at Lake Lanier Ga.

APOCALYPTICA RETURNS

Apocalyptica's third album, titled "Cult," is set for release on October 2nd (apparently outside the USA). This latest release features two Metallica covers, Fight Fire With Fire and Until It Sleeps. Most of you remember Apocalyptica as a Finnish Cello Quartet, who's previous two album were made up of mostly cover songs, mostly of Metallica songs.

TIMBALAND

Timbaland, the renowned hip-hop producer who recently helped craft such hits as Aaliyah's "Try Again" and Jay-Z's "Big Pimpin'," is now turning his attention toward alternative rock and has lined up studio time with Beck and Papa Roach. But he has bigger plans in mind, specifically with Metallica. Says the producer, "I really wanna do a song with Metallica. I really like that track they did for the 'Mission: Impossible 2' film." Now THAT would be interesting...

LARS ROCKS WITH ROCK

Lars popped up in Cleveland today at the Blossom Music Center, where his friend "Bobby" was performing. Lars joined Bobby, best known as Kid Rock for half of American Badass.

James Hetfield is one of many that graces the latest issue of Rolling Stone magazine. Included in the issue is a rather brief interview with Lars, which mentions, amongst other things that this tour takes place "in the middle of a year off," and that he is "Napstered out."




ACTION FIGURES

"Just because a certain metal band is busy suing Web sites for copyright violations doesn't mean the band doesn't have other things on its collective mind. Like action figures. Word has it the band is excited over the much-rumored concept sketches that have been floating around. Now the questions: Will it happen? When? Long hair or short? Stay tuned, grasshopper, and keep head-banging."

Todd McFarlane, the creator and brains behind the project, is responsible for movies, comics and action figures, among other activities (including buying Mark McGwire home run balls - #70). He was responsible for bringing Spider Man back to life and started his own upstart comic company with partners, Image Comics. McFarlane started making toys in 1995 and has since made incredibly accurate renditions of Rob Zombie, Ozzy, Kiss and Alice Cooper. Kid Rock and Janis Joplin figures are on the way. The bottom line is that ff these figures do see the light of day, they will be done well. You can check out more about the toys by clicking here.

OPENING ACT CONFIRMED

"Corrosion of Conformity, author's of great slab's of metal like "Vote With a Bullet" and "Clean My Wounds", have been pulled out of the studio to open for Metallica once again. CoC will be playing at the "bonus shows" in Dallas and Atlanta. You may recall that CoC opened for Metallica during the Poor Touring Me Tour of '96 and '97.

When asked about their opening slot, CoC's drummer Reed Mullin had this to say: - "We were recording our new album, America's Volume Dealer, when we got a call from James. He said You MUST play with Metallica! We said HELL YEAH! We're very excited about these shows in Dallas and Atlanta. This will give us the opportunity to play some new tunes, some old tunes, and, of course, some show tunes."
