Links to stories regarding the Metallica lawsuit: Sonic Net At Save Napster, there's an interesting letter we'd like to quote parts of:
Napster, the ball is in your court now, make a wise decision. Metallica, good luck in your valiant efforts in fighting music piracy as well as maintaining the integrity of art, just please reconsider your motivation as well as your target. Make the unlawful users pay the price, not the schools.
NEWS RELEASE
Metallica Files Suit Against Napster, University of Southern California, Yale University, Indiana University NEW YORK--(BUSINESS WIRE)--April 13, 2000-- Suit alleges that Defendants have violated the law by committing continuing copyright infringements, unlawful use of digital audio interface device, and violations of the Racketeering Influenced & Corrupt Organizations Act (RICO) Internationally renowned recording artists Metallica, E/M Ventures and Creeping Death Music have today filed suit in U.S District Court Central District of California against Napster, Inc., The University of Southern California, Yale University, and Indiana University. Metallica, E/M Ventures and Creeping Death Music are the copyright owners of sound recordings and musical compositions created by Metallica and possess the exclusive right to commercially distribute these songs and sound recordings and derive income therefrom. The suit alleges that Napster and the other defendants - by encouraging and enabling visitors to its website to unlawfully exchange with others copyrighted songs and sound recordings without the knowledge or permission of Metallica - have violated the law by committing continuing copyright infringements, unlawful use of digital audio interface device, and violations of the Racketeering Influenced & Corrupt Organizations Act (RICO). Says Metallica drummer Lars Ulrich, "With each project, we go through a grueling creative process to achieve music that we feel is representative of Metallica at that very moment in our lives. We take our craft - whether it be the music, the lyrics, or the photos and artwork - very seriously, as do most artists. It is therefore sickening to know that our art is being traded like a commodity rather than the art that it is. From a business standpoint, this is about piracy - a/k/a taking something that doesn't belong to you; and that is morally and legally wrong. The trading of such information - whether it's music, videos, photos, or whatever - is, in effect, trafficking in stolen goods." Further the suit states that, "Napster has devised and distributed software whose sole purpose is to permit Napster to profit by abetting and encouraging the pirating of the creative efforts of the world's most admired and successful musical artists. Facilitating that effort are the hypocritical universities and colleges who could easily block this insidious and on going thievery scheme. The last link in the chain are the end users of the stolen musical works, students of these universities and others who exhibit the moral fiber of common looters loading up shopping carts because "everybody else is doing it." Metallica released their first album, Kill'em All, in 1983, and since that time have released 9 albums including 2 double albums. They have won 5 Grammy Awards and have sold more than 50 million albums through normal retail channels in the United States alone. Their 1991 album Metallica with sales of over 12 million copies is the 3rd largest selling album since the inception of Soundscan (the company which provides accurate sales information for the music industry) and continues to sell close to a million copies a year. SPIN REPORT
Spin magazine says: Metallica: We Will Announce No Dates Before It's Time Read the story here. PM5K JOIN THE TOUR?
ShoutWeb, who had originally posted a few stories with false info, returns with more news. They say: Powerman 5000 have now been officially confirmed to be on the upcoming Korn/Metallica/System Of A Down/Kid Rock tour. Orgy, Staind and the Stone Temple Pilots are rumored openers. The tour is set to take place late June through mid July. Expect confirmed dates to be announced shortly. The site has not stated who "officially announced" this information, as nothing regarding the tour has been "officially announced" as of yet. We, here at Inter Sandman originally announced Powerman 5000 were amongst the contenders for an opening slot a few days ago, and we do believe they may still be amongst the openers. METALLICA.COM UPDATES
The Metallica Club has posted the following updates: In other news, Korn.com has removed the dates previously listed on their website and we have posted a new ISOnTour page, check it out here. 'I DISAPPEAR' VID
MTV.com confirms that Metallica will be doing a video shoot for their contribution to the Mission: Impossible 2 soundtrack later this month. Hollywood Records, the record company releasing the soundtrack. Regarding the MTV Movie Awards performance, MTV had the following to say:
While video plans are in the works, talk of the band rolling out the song at this year's MTV Movie Awards may be premature. Elektra Records, which handles Metallica, had reported on its official Web site that the band would play the Movie Awards in May, but reps for the show note that the event won't be staged until June and that they are far from lining up performers for the show. OFFICIAL DATES
Korn.com posted the following information tonight:
Korn will be playing several dates this summer at speedways. The bill will be System of a Down, Kid Rock, Korn & Metallica. The dates are as follows: OPENERS
We're hearing lots of names tossed around as to who Metallica is touring with this summer. Korn and Kid Rock appear to be a lock as #2 and #3 on the bill. We're also hearing that Powerman 5000 will be added to the bill. Other possible 4th or 5th acts include: System of a Down, Orgy and STP. UPDATE: System Of A Down.com reports that "System of a Down will be on tour with Metallica from the end of June through mid-July. Stay tuned here for details and confirmed dates. Confirmed artists on the tour include Metallica and S.O.A.D. Artists to be confirmed include Korn, Kid Rock, and Stone Temple Pilots." - Thanks to UBQ. TOUR DATES??
Shout Web reports the dates for the upcoming tour as: (DATES REMOVED DUE TO INACCURACY)This site also reports that Orgy will probably be joining the bill. However, this site credits "The Official Metallica Fan Club" as the source for this info, this part is inaccurate, as The Metallica Club has not confirmed any dates, shows or opening act info. The site reported earlier that the Metallica Club Members Area contained info confirming Korn on the bill, this is also inaccurate. Are these dates accurate? They could be, however something doesn't seem right, especially as their "credit" for the info seems off base. UPDATE: On April 4th, Korn.com DISCREDITED these tour dates from Shout Weband posted the OFFICIAL tour dates, which have since been posted on IS News. VH-1 SPECIAL
We've previously mentioned that the Metallica "Fans" special will premiere on VH-1 in May. Elektra has announced that Metallica will be the subject of a four-hour VH1 special on May 14, we're not sure if the running time of "Fans" is 4 hours, or if it's part of block of Metallica material.
Elektra has also confirmed Metallica's appearance on the MTV Movie Awards, says the band is getting to work on a video for I Disappear, and has a small bit of info on the S&M DVD. TOUR INFO
We've gotten e-mail from several people that another website has posted this: "The special members only section of Metallica.com confirms Korn as the double act in the upcoming summer tour. There is no mention of Kid Rock, but a 15 show stadium tour is confirmed." NOWHERE on www.metallica.com is there any confirmation of opening acts or the number of shows. In the Message Board Forum of the Members Only, there some minor details about the upcoming tours. (These details are for members only and will not be posted on Inter Sandman). Inter Sandman has previously posted that there will probably be around 12 dates at various race tracks, with Korn and Kid Rock probably opening. But this is still UNOFFICIAL, and has NOT confirmed by www.metallica.com. S&M DVD..
The S&M DVD has been delayed...... again. The new tenative release date in June 20th. ANTON CORBJIN
On Thursday night Dutch TV-station 'Nederland 3' broadcasted a documentary called Anton Corbijn - Geen stil leven. You'll probably know Corbijn as the photographer reponsible for many of the Metallica photos from the last 5 years, notably those from Load, ReLoad and the S&M booklets, he's also responsible for the music videos for Hero of the Day and Mama Said. Include in the documentary were interviews with Corbijn himself, Bono, Brian Eno and Lars. The footage with Lars was circa November '99 and featured footage with the Berlin Symphony. Thanks to Ruud for the story. MTV MOVIE AWARDS Metallica will perform I Disappear at the upcoming MTV Movie awards. The Awards takes place this May. KORN TOUR... Korn was on Rapid Fax on Much Music today and in an interview said they will be touring with Metallica and Kid Rock this summer. They confirmed that the venues will be 'insane' as they will be raceways. They also mentioned that there will only be 11-12 shows done. Thanks to Chris. Also, in other news, another Metallica song made its way onto the HBO show The Sopranos. In the latest episode, you can hear 'The Memory Remains' being played at the Bada Bing strip club. Previously, 'King Nothing' had appeared. AMERICAN BADASS Kid Rock went to work this weekend on his video for American Badass. This song, which contains samples of Sad But True, was originally reported to be a cover of the Metallica song. The song appears on the Detroit native's forthcoming album, The History of Rock and is due on May 30th. The video is directed by David Meyers. FOOLED?
